Welcome to SusuPay! These Terms and Conditions ("Terms") govern your use of the SusuPay mobile application and all related services (collectively, the "Service"), provided by SusuPay ("we," "us," or "our").
By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.
1. Description of Service
SusuPay is a technology platform that facilitates community-based finance. Our services include:
Digital Susu: A feature to create, join, and manage rotational savings groups.
Peer-to-Peer (P2P) Lending: A marketplace where users can request ("Borrowers") and fund ("Lenders") personal loans.
Collateral Loan Marketplace: A marketplace for Borrowers to list an item as collateral to secure loan offers from Lenders.
Legal Disclaimer: SusuPay acts as a facilitator and intermediary. We are not a bank, a licensed credit provider, a financial institution, or a lender. We do not offer loans from our own funds. All loan agreements, susu contributions, and collateral arrangements are made strictly between the users of the platform.
2. Eligibility and Account Registration
To use our Service, you must be at least 18 years old and a resident of Ghana. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated. You are responsible for safeguarding your password and for all activities that occur under your account.
3. Know Your Customer (KYC) Verification
To ensure the safety and security of our community, all financial features of the Service require mandatory KYC verification. This process involves submitting:
A valid, government-issued photo ID (Ghana Card, Voter ID, or Passport).
A recent utility bill (not older than 3 months) for address verification.
The names, phone numbers, and relationship of two (2) personal beneficiaries or emergency contacts.
By submitting this information, you authorize SusuPay to verify your identity. Your ability to access features like lending, borrowing, or creating a susu group is contingent upon successful KYC verification. All submitted documents are stored securely and handled in accordance with our Privacy Policy.
4. Core Features & User Responsibilities
4.1. Susu Contributions: When you join or create a susu group, you commit to making your contributions on time according to the group's agreed-upon schedule. Failure to do so may impact other members and could result in suspension from the platform.
4.2. Direct Pair P2P Loans:
Borrowers are responsible for posting clear, honest loan requests and for repaying the loan principal plus any agreed-upon interest by the due date.
Lenders fund loans at their own risk. SusuPay holds the funded amount in an administrative escrow account. These funds will only be released to the Borrower after our administrative team has performed verification checks.
4.3. Collateral Loans:
SusuPay acts solely as a marketplace to connect Borrowers and Lenders for collateral-backed loans.
SusuPay does not take physical possession of, inspect, value, or insure any item listed as collateral. The agreement, including terms of collateral holding and return, is strictly between the Borrower and the Lender. We strongly advise users to document their private collateral agreements thoroughly.
5. Payments, Wallet, and Fees
Payments: All financial transactions on the platform are processed through our third-party payment provider, Paystack. By using our Service, you agree to be bound by Paystack's terms and conditions.
SusuPay Wallet: Your in-app wallet is used to hold funds from rewards, referrals, or for settling transactions within the app.
Service Fees: SusuPay may charge service fees for certain transactions, such as susu contributions, escrow services, or completed loans. All applicable fees will be clearly disclosed to you before you confirm any transaction.
6. User Conduct
You agree not to use the Service to:
Engage in any fraudulent, deceptive, or illegal activities.
Provide false or misleading information during KYC or in any loan request.
Harass, threaten, or infringe on the rights of other users.
Attempt to circumvent our fee structure or escrow system.
Violation of these rules may lead to an immediate review, suspension, or termination of your account.
7. Dispute Resolution
Disputes Between Users: SusuPay provides tools to facilitate communication but is not a party to disputes between users. We encourage users to resolve disagreements amicably. We may, at our discretion, provide transaction data or other relevant information to assist in resolving a dispute.
Disputes with SusuPay: If you have a dispute with us, please contact our support team first. Most issues can be resolved quickly this way.
8. Limitation of Liability
The Service is provided on an "as-is" and "as-available" basis. SusuPay makes no warranties regarding the reliability, timeliness, or accuracy of the Service. To the fullest extent permitted by law, SusuPay shall not be liable for any indirect, incidental, or consequential damages, including losses of profits, data, or goodwill, arising from your use of the Service or from any loan or susu agreement you enter into with another user. Our liability to you for any cause whatsoever will at all times be limited to the amount of fees, if any, you paid to us in the 6 months prior to the claim.
9. Amendments to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on the platform and updating the "Effective Date." Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana, without regard to its conflict of law principles.
